Terms of Service

These Terms of Service ("Terms") govern access to and use of the Ezy Sign-In platform and related services ("Service").
The Service is operated by Checking & Management Systems Pty Ltd as trustee for The T.J. Trust trading as Ezy Sign-In ("Ezy Sign-In", "we", "our", or "us"). By accessing or using the Service you agree to be bound by these Terms

Description of the Service

Ezy Sign-In provides a cloud-based workplace management platform designed to assist organisations in managing visitor registrations, contractor inductions, workplace attendance records, document collection and related compliance processes.
The Service may include features such as:

1. visitor and contractor sign-in

2.  induction management

3. document uploads and record keeping

4. reporting and dashboards

5. notifications and messaging services

6. system integrations and APIs

Ezy Sign-In may update, modify, enhance or discontinue features of the Service from time to time.

We are committed to the protection of Your privacy while You use the Product. This Privacy

Policy only applies to the Product. The Product may contain links to other websites or applications, but if that is the case, the Privacy Policy does not apply to any of those linked websites or applications.

We gather certain information from users of the Product, so this Privacy Policy explains what information we collect, how we use it, and your rights in relation to it.

By continuing to use the Product You acknowledge that You have had the chance to review and consider this Privacy Policy, and You acknowledge that You agree to it. This means that You also consent to the use of Your information and the method of disclosure as described in this Privacy Policy. If You do not understand the Privacy Policy or do not agree to it then please do not use the Product.

Accounts

Access to the Service may require creation of an account.

Customers are responsible for:

  1. maintaining the confidentiality of login credentials
  2. ensuring authorised use of their account
  3. all activities conducted under their account

Customers must notify Ezy Sign-In immediately if they believe their account has been compromised.

Licence to Use the Service

Subject to these Terms and an active subscription, Ezy Sign-In grants customers a limited, non-exclusive, non-transferable licence to access and use the Service for internal business purposes.

The Service is licensed, not sold.

Customers must not:

I. copy, reproduce or modify the platform

II. reverse engineer or attempt to extract source code

III. resell or sublicense the Service

IV. interfere with operation of the Service

V. access data belonging to other customers

Acceptable Use

Customers must not use the Service to:

a. violate laws or regulations

b. distribute malicious code

c. attempt unauthorised system access

d. interfere with platform operation

e. unlawfully collect or process personal data

Ezy Sign-In reserves the right to suspend accounts that violate acceptable use requirements.

Subscription Terms

Subscriptions are provided on a prepaid basis for the selected billing period.

Subscriptions automatically renew for successive terms unless cancelled prior to renewal.

Customers may cancel by contacting Ezy Sign-In support in writing.

Cancellation prevents renewal but the Service remains active until the end of the current paid term.

All subscription fees are non-refundable.

Ezy Sign-In reserves the right to update subscription pricing upon renewal.

SMS Messaging Charges

Where SMS messaging is used within the Service, SMS usage is billed separately from subscription fees.

Customers are responsible for all SMS messages sent through their account.

SMS delivery relies on third-party telecommunications providers and cannot be guaranteed.

Hardware Supply

Ezy Sign-In may supply third-party hardware such as tablets, printers or kiosk equipment.

Hardware is provided for customer convenience and manufactured by third-party vendors.

All hardware sales are final and non-refundable unless required under applicable consumer law.

Hardware Support

Ezy Sign-In does not provide warranty or repair services for hardware.

Customers must contact the relevant manufacturer for hardware support.

Customer Compliance Responsibilities

Customers are responsible for ensuring their use of the Service complies with applicable workplace, privacy and data protection laws.

Ezy Sign-In provides tools to assist with workplace management but does not guarantee regulatory compliance.

Visitor Data Responsibility

Customers are responsible for ensuring visitors and contractors are informed of data collection and that appropriate consent or lawful authority is obtained where required.

Customers remain responsible for how personal information collected through the Service is used.

Document Storage

Customers may upload documents including insurance certificates, licences, safety records or compliance documents.

Customers are responsible for ensuring such documents are lawfully collected and stored.

Ezy Sign-In does not verify the accuracy, authenticity or legal validity of uploaded documents.

Identification Documents

If identification documents such as driver licences or passports are collected using the Service, customers are responsible for ensuring such collection complies with applicable laws.

Ezy Sign-In assumes no responsibility for regulatory compliance relating to identification records.

Data Security

Ezy Sign-In implements commercially reasonable technical and organisational measures designed to protect customer data.

However, no system can guarantee absolute security and customers acknowledge risks associated with internet-based systems

Administrative Access

To investigate technical issues or provide support, authorised Ezy Sign-In personnel may access customer accounts where reasonably necessary.

Access is restricted to authorised personnel and may be logged or monitored.

Service Availability

Ezy Sign-In uses commercially reasonable efforts to maintain service availability but does not guarantee uninterrupted operation.

Service interruptions may occur due to maintenance, infrastructure changes, or third-party service disruptions.

Third-Party Infrastructure

The Service may rely on third-party providers including cloud hosting providers, telecommunications networks and integrated services.

Ezy Sign-In is not responsible for disruptions caused by such third-party providers.

Integrations and APIs

The Service may allow integrations with third-party systems.

Ezy Sign-In does not guarantee compatibility with third-party services and is not responsible for failures resulting from external integrations.

Data Backup

While reasonable safeguards are implemented, customers are responsible for maintaining copies of critical records.

Ezy Sign-In shall not be responsible for loss of data except where required under applicable law.

Beta Features

From time to time Ezy Sign-In may release beta features for evaluation.

Beta features may be modified or withdrawn and are provided “as is

Intellectual Property

All intellectual property rights in the Service remain the property of Ezy Sign-In or its licensors.

Customers receive only the licence described in these Terms

Suspension or Termination

Ezy Sign-In may suspend or terminate access to the Service if customers:

  • breach these Terms
  • misuse the Service
  • create security risks
  • fail to pay subscription fees

Limitation of Liability

To the maximum extent permitted by law, Ezy Sign-In shall not be liable for indirect, incidental, consequential or special damages including loss of profits, loss of data or business interruption.

Total liability shall not exceed the subscription fees paid during the twelve months preceding the claim.

Nothing in these Terms excludes rights under Australian Consumer Law.

Indemnity

Customers agree to indemnify Ezy Sign-In against claims arising from misuse of the Service, violation of these Terms, or unlawful handling of personal information.

Force Majeure

Ezy Sign-In shall not be liable for delays or failures caused by events beyond reasonable control including internet outages, cyber incidents, natural disasters or government actions.

Dispute Resolution

The parties agree to attempt to resolve disputes through good faith discussions.

To the extent permitted by law, claims must be brought individually and not as part of a class action.

Governing Law

These Terms are governed by the laws of Victoria, Australia.

Changes to Terms

Ezy Sign-In may update these Terms from time to time.

Updated Terms will be published on the website and continued use of the Service constitutes acceptance.
